NAME We, the students of California State University, Monterey Bay do hereby declare that this organization shall henceforth be recognized as the CSUMB Anime Club.ARTICLE II. DERIVATION OF AUTHORITY The CSUMB Anime Club recognizes that it receives its right to function as an Institute organization of the Student Activities Department of CSUMB in accordance with the Student Activities Department's Constitution.ARTICLE III. PURPOSE The purpose of the CSUMB Anime Club is to provide enrichment and insight into Japanese culture through the means of Japanese Animation, Manga, and other media to both the university and its surrounding communities.ARTICLE IV. RIGHTS AND RESPONSIBILITIES Section 1. Pursuit of GoalsThe CSUMB Anime Club has a right to pursue any activities in achieving its stated goals, as long as those activities are not in violation of any of the rules and regulations of the Student Activities department and CSUMB. Section 2. Executive Attendance The CSUMB Anime Club shall have at least one member of the Executive Board, or other responsible party, present at each regularly scheduled club meeting. Section 3. Rules and Regulations The CSUMB Anime Club shall strictly adhere to all the rules and regulations of the Student Activities department and CSUMB. Section 4. Inter Club Council The CSUMB Anime Club has the right to obtain a seat in the Inter Club Council, in accordance with the policies of the Student Activities department. Section 5. Chair of Inter Club Council The CSUMB Anime Club shall have the right to nominate and elect the executive board of the Inter Club Council, in accordance with the election policies of the Student Activities department, the Inter Club Council and Student Government. ARTICLE V. MEMBERSHIP Section 1. QualificationMembership is open to regularly enrolled undergraduates, post-graduates, faculty, staff, night students, alumni, and members of the community who are in good standing, as defined in Article V, Section 5. Section 2. Full Membership Full members shall be those in good standing, as referred to in Article V, Section 5, who have met the qualifications set forth in Section 1, along with those of the Student Activities department. Section 3. Associate Membership Associate members shall be those who have an interest in the club but no desire to actively participate in club affairs. Associate members do not pay dues and do not gain the benefits of active members. They may attend meetings and discussions, but they shall not have the power to vote in the organizations, cannot hold office, and do not have access to the club library. Section 4. Dues Dues shall be set by the Executive Board and stated in the By-Laws, stated in Article XIV, Section 5. Section 5. Good Standing A member in good standing shall be an active member who has paid his dues to date. Only members in good standing shall be eligible to vote. Section 6. Resignation A member may resign by submitting the intention in writing to the president. The resignation shall be read to the members at the next business meeting, although it becomes effective upon submission. ARTICLE VI. EXECUTIVES Section 1. ExecutivesThe Executives of this organization shall be in order of rank: A. President B. Vice President C. Treasurer D. ICC Representative E. Publicity F. SACD Liaison G. Librarian H. Webmaster Section 2. Qualifications Qualifications for office shall be to maintain a good academic standing as defined by CSUMB. In order to be eligible for nomination for an Executive Board position, a member must have been active in the club for the previous semester, not including summer or winter intersession. Section 3. Length of Service The Executives shall be elected in a manner provided in the constitution and shall serve on calendar year starting on the first meeting in fall quarter. Executives are eligible for re-election. ARTICLE VII. ADVISOR Section 1. Number of AdvisorsThere shall be at least one advisor. Section 2. Qualifications Only CSUMB staff and faculty are qualified to become advisors without the permission of the Director of Student Activities. Section 3. Resignation Upon resignation, the Director of Student Activities must be informed. Section 4. Duties The duties of the advisor shall be to insure that the club follows Institute rules and regulations. ARTICLE VIII. DUTIES OF EXECUTIVES Section 1. President* To preside over all regular and special meetings of the organization. * Exercise general supervision over regular club activities. * Approve all committees, regular or special. * Preside over the Executive Board. Section 2. Vice President * Take over the duties of the President or SACD Liaison in the absence of either or both. * Keep an accurate roll of members and keep the minutes of all meetings. * Plan and execute the annual club convention event, including all planning and organizing. Section 3. Treasurer * Take over the duties of the Vice President or SACD Liaison in the absence of either or both. * Supervise all financial transactions of the organization which have been approved by the Executive Board and to keep all financial records of these transactions. * Maintain regular contact with the Director of Finance of the Student Activities department as well as the Financial Director of the Student Government. Section 4. ICC Representative * Attend all Inter Club Council meetings, and relay information at business meetings. * Prepare and present monetary proposals to the Inter Club Council. * Be an active voting member of the Inter Club Council as defined in the organization's Constitution. Section 5. Publicity * The Public Relations Executive shall be responsible for the advertisement of all club activities. Section 6. SACD Liaison * The SACD Liaison shall be responsible for requisitioning rooms and equipment for the club's uses. * The SACD Liaison shall be responsible for requisitioning rooms and equipment for the club's uses. * Maintain contact with the Student Activities department, and be the primary link between the Student Activities department and the club. Section 7. Librarian * The Librarian shall be responsible for maintaining the club library. * The Librarian shall be responsible for all material signed out of the club library and its return. * The Librarian shall be responsible for creating and maintaining licenses for both Anime in the club library as well as Anime to be shown at meetings and events. Section 8. Webmaster * The Webmaster is responsible for all updates and maintenance of the club webpage. ARTICLE IX. EXECUTIVE BOARD Section 1. DutiesThe management of this organization shall be vested in the Executive Board. Section 2. Membership The Executive Board shall be composed of the President, Vice President Treasurer, ICC Representative, Publicity, SACD Liaison, Librarian, and Advisor. Section 3. Meetings The Executive Board shall meet at least once a month and report to the members at the following general meetings. Section 4. Vacancy in the Executive Board The Executive Board shall fill any permanent vacancy of office by appointment, excepting the Presidency. Section 5. Vacancy in the Presidency In the case of a permanent vacancy in the office of the Presidency, a special election shall be held in the manner of annual elections as set forth in the constitution. ARTICLE X. MEETINGS Section 1. General MeetingsMeetings shall be held weekly at a time and place determined by the Executive Board. Section 2. Special Meetings Special meetings may be called by the President upon 24 hour notice. Section 3. Requirements for Business In order for any business to take place at a meeting a quorum must be present. A quorum shall be presumed unless challenged from the floor by a member in good standing. ARTICLE XI. ELECTIONS Section 1. Date of ElectionsElections shall take place at a date and time designated by the Executive Board. This date and time will be communicated to the club no less than one week before the date the elections are to be held. Section 2. Nominations Nominations for office shall be made from the floor at the meeting prior to the election by any member in good standing. A person may be nominated for more that one office. Section 3. Quorum A voting quorum shall consist of one more than half the voting members. Section 4. Voting Votes shall be conducted by either a roll call method or a public display of hands or rising. A simple majority is all that is necessary to win. Section 5. Limitations No member may hold more than one position on the Executive Board unless there are insufficient members in good standing nominated for a position. Section 6. Installment of Executives Installment of new Executive shall take place at the meeting after elections. ARTICLE XII. IMPEACHMENT Section 1. ImpeachmentAny executive of this organization can be impeached. Section 2. Initiation Impeachment may be initiated by petition, in writing, by one quarter or more of the active members, when presented by the members in a regular meeting. Section 3. Proceedings At the next meeting the accuser, members signing the petition, and accused Executive Board member in question, shall present their case to the members. After both cases are heard, a roll call vote shall be taken. In the case of an absence, the case is decided in the favor of the attending party. Section 4. Vote Conviction of impeachment shall require a two-thirds vote by members in good standing present, a quorum being present. Section 5. Conviction Conviction of impeachment shall cause a removal from office and loss of all privileges thereof. Section 6. Filling the Vacancy from Conviction The filling of an office vacated by impeachment shall be a special election held in the manner of annual elections. ARTICLE XIII. AMENDMENTS Section 1. ProposalAmendment to this constitution may be proposed by any member in good standing, in writing, at any business meeting. There must be copies made for all members present. Section 2. Voting The proposed amendment shall be voted by a roll call vote or a public display of hands at the next business meeting, a quorum being present. Section 3. Passage The passage of the amendment requires a two-thirds affirmative vote of all members in good standing present. Section 4. Adoption Before the proposed amendment shall become operation it must be approved by the Director of Student Activities. ARTICLE XIV. BY-LAWS Section 1. ProposalBy-Laws of this organization can be proposed in writing at any meeting by any member in good standing. Section 2. Voting An immediate vote, after discussion, shall be taken by a show of hands and a simple majority is necessary for passage, a quorum being present. Section 3. Adoption By-laws do not require the approval of the Student Activities department. Section 4. Hazing and Harassment There will be no hazing or harassment of any kind in this organization in accordance with state laws. Actions are grounds for immediate dismissal. Section 5. Dues Dues shall be paid to exercise the use of the club library, to exercise voting privileges, and to provide other benefits as established by the Executive Board. Dues shall be set by the Executive Board. The current dues for the CSUMB Anime Club are $5.00 annually. Section 6. Mailing List The mailing list, with the assistance of modern technology, shall be distributed to membership via e- mail. E-mail messages shall not violate CSUMB Policies. CSUMB Student Government, Student Activities department, and CSUMB Anime Club claim no responsibility for the content of E-mail. Section 7. Suitability of Materials The club will not show during general meetings or special events any 'hentai' (X-Rated) materials. This material is available in the library, but identification is required. A verbal as well as written warning will be provided during all library transactions. Section 8. Checks and Balances A majority of Executive Board members may vote to override another Executive Board member's personal decisions regarding an aspect of their duties, if the majority feels that the offending Executive Board member is doing their job inefficiently. Section 9. Library Policy Library policy and procedures are contained in the supplemental document "Library By-laws". These bylaws can be changed following the guidelines for changing by-laws as set in the Constitution and its by-laws. ARTICLE XV.
